Terms of Service
Effective September 21, 2026
The short version. Your data is yours and you can take it or delete it whenever you want. CheckPunch is early software run by one person, so it comes with no uptime guarantee and should not be the only place something important is written down. You can stop using it at any time, with no notice and no penalty.
Who this is between
These terms are an agreement between your business and CheckPunch, which is built and run by Mason Barnocky in Bozeman, Montana. Creating an account means agreeing to them. If you are agreeing on behalf of a business, you are confirming you are allowed to do that.
What CheckPunch does
CheckPunch gives your staff a checklist to work through on a shift, lets them attach photos and flag problems, and shows you afterward what was completed and what was not. That is the whole product. Anything it appears to promise beyond that, it does not.
Your account
You are responsible for what happens under your account, including keeping your password to yourself and deciding who you invite. Tell us promptly if you think someone has gotten in who should not have.
Your staff and their PINs
Staff PINs identify who worked a shift. They are a convenience, not a security system: a four-digit PIN on a shared tablet can be watched over a shoulder or passed around, and you should assume it sometimes will be. Treat the name attached to a completed checklist as a good-faith record of who did the work, not as proof.
Your data stays yours
You own everything you and your staff put into CheckPunch. You are giving us permission to store and process it in order to run the service for you, and nothing else. We do not sell it, license it, or use it to train models. If you leave, you can take it with you.
Photos
Photos are stored privately and served only through expiring links, but what is in the frame is up to you. Make sure your staff know that photos taken on a shift are visible to management, and set up your checklists so that photo-required items point at equipment, rooms, and conditions rather than at people. You are responsible for having the right to upload what you upload, and for following any laws that apply to recording inside your own premises.
What CheckPunch is not
CheckPunch is not a timeclock, a payroll system, or a wage-and-hour record. It records that a task was checked off, not that a person was on the clock. Timestamps exist to tell you when work got done, and they are not designed, tested, or accurate enough to support payroll, scheduling compliance, or any dispute about hours worked. Do not use them that way, and do not let a manager start.
It is also not a compliance or food-safety record of the kind a health inspector, insurer, or regulator requires. If a rule says you must keep a log, keep the log that rule asks for. CheckPunch can sit alongside it; it cannot replace it.
Reasonable use
Please do not:
- Use CheckPunch for anything illegal, or to harass anyone.
- Upload malware, or try to break into other businesses’ data.
- Hammer the service in a way that degrades it for other people.
- Resell or rebrand CheckPunch as your own product without written permission.
An account doing any of the above can be suspended, and if it is, you will be told why.
Availability, and what happens when it breaks
There is no uptime guarantee. CheckPunch is early software maintained by one person who also has a job and a degree to finish. It will occasionally be down, and it may be down at an inconvenient hour. Features can change, and a feature you rely on could be altered or removed, though we will give notice before removing something significant.
Practically: if a shift matters and CheckPunch is unreachable, use paper for that shift. The product is meant to replace a clipboard, not to become a single point of failure.
Price
CheckPunch is currently free for early customers. That may change. If a price is ever introduced for an account that has been free, that account gets at least 30 days of notice first and can simply decline and stop using the service. You will never be charged without having agreed to a price in advance.
Ending it
You can stop at any time, for any reason, without telling us why. Deleting your business from Settings starts a 30-day grace period, after which the data and every attached photo are permanently removed. Ask before that window closes and you will get an export.
We can also end an account, for the reasons under Reasonable use or if the service is discontinued. If CheckPunch is ever shut down, customers get at least 30 days of notice and a way to export their data first.
No warranties
CheckPunch is provided as is, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that it will catch every missed task.
Limit on liability
To the fullest extent the law allows, CheckPunch is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost business, or lost data arising out of your use of the service. Total liability for any claim is capped at the greater of the amount you paid CheckPunch in the twelve months before the claim, or one hundred dollars.
Some states do not allow certain limitations, in which case the limits above apply only as far as that state permits.
Changes to these terms
If these terms change materially, account holders will be emailed before the change takes effect. Continuing to use CheckPunch after that means accepting the new version. The date at the top reflects the current one.
Governing law
These terms are governed by the laws of the State of Montana, without regard to its conflict-of-law rules. Before anything formal, please email and try to sort it out; almost everything can be.
